Lawmakers are tackling a bill today that would allow police to test drivers for operating under the influence of marijuana. More specifically the amout of THC, the plant’s active ingredient, a driver has consumed. The bill would set a blood-level limit that’s modeled on alcohol blood-level limits. This allows cops to use new breath-testing equipment as it’s developed, similar to a breathalyzer.

The bill makes driving under the influence of marijuana at a level of 5-nanograms or more a criminal offense. Colorado also uses a 5-nanograms of THC per milliliter of blood standard. Washington uses a standard of 25-nanograms. Illinois is looking to set a 15-nanograms per milliliter level.

Opponents say alcohol and marijuana should not be treated the same in judging whether a driver is impaired. They say pot smokers can built up a tolerance to THC. 5-nanograms may not impair the user at all. THC levels also stay in a users bloodstream days after marijuana was ingested. The bill also doesn't address how cops should deal with medical marijuana patients.
